ARA----------------------------If a person's name is registered in the voter list at two places, then it is a serious irregularity according to the Indian electoral law. The following legal provisions and action can be taken for this.
In India, a person can vote in only one constituency. It is considered a crime under Section 17 and 18 of the Indian Penal Code (IPC) and the Representation of the People Act, 1950 and 1951. If someone intentionally registers the name at two places, then it comes under the category of fraud.
By the Election Commission. Names can be removed from one place after investigation. Explanation can be sought from the concerned person. Answer can be sought from BLO (Booth Level Officer). Deliberately having a name in two places is punishable by up to 6 months in jail or fine or both (under section 31 of the Representation of the People Act). If the person votes from both the places, then it is an even more serious crime, which can lead to severe punishment.
The Election Commission should regularly check duplicate names. People should be made aware that if their name is in two places, then they should get it removed from one place themselves (by filling Form 7). BLOs should be instructed to work responsibly.
