Users are responsible for all applicable taxes and fees related to Service usage. Advance notice will be provided for any pricing changes, and Users may cancel their subscriptions at any time.

13. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or the relationship between you and Reportage News International (RNI) shall be subject to the exclusive jurisdiction of the courts located in Mathura District. Specifically, the District Court of Mathura shall have exclusive jurisdiction for any legal proceedings.

By using the Service, you expressly consent to the jurisdiction and venue of these courts and waive any objections regarding inconvenient forum or lack of jurisdiction.

14. DISCLAIMER OF WARRANTIES

The Service is provided on an “as is” and “as available” basis without any warranties of any kind, either express or implied.

To the fullest extent permitted under the laws of India, Reportage News International (RNI) disclaims all warranties, including but not limited to:

  • Implied warranties of merchantability

  • Fitness for a particular purpose

  • Non-infringement

  • Accuracy, reliability, or completeness of information

RNI does not guarantee that:

  • The Service will be uninterrupted or error-free

  • Defects will be corrected

  • The platform or servers are free of viruses or harmful components

  • Third-party links or services are secure or accurate

Your use of the Service is entirely at your own risk.

15. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, RNI, its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, consequential, punitive, or special damages, including but not limited to:

  • Business interruption

  • Loss of goodwill

arising out of or related to:

  • Your use or inability to use the Service

  • Third-party websites or services

  • Unauthorized access to user data

  • Errors or omissions in content

In no event shall the total liability of RNI exceed the amount paid by the User (if any) for accessing the Service during the preceding 12 months.

16. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless RNI and its officers, employees, affiliates, and partners from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of:

  • Your use or misuse of the Service

  • Your violation of these Terms

  • Your violation of any law or third-party rights

  • Content you submit, post, or transmit through the Service

17. TERMINATION

RNI reserves the right to suspend or terminate your access to the Service at any time, without prior notice, if:

  • You violate these Terms

  • Your activities harm the platform or other users

  • Required by law or regulatory authorities

Upon termination:

  • Your right to use the Service will immediately cease

  • Certain provisions (including liability, indemnification, and jurisdiction clauses) will continue to remain in effect.

18. DISPUTE RESOLUTION & ARBITRATION

Before initiating legal proceedings, both parties agree to attempt to resolve disputes amicably through negotiation.

If the dispute cannot be resolved within 30 days, it shall be referred to binding arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996.

Key arbitration terms:

  • The arbitration shall be conducted by a single arbitrator appointed mutually by the parties.

  • The seat and venue of arbitration shall be Mathura, Uttar Pradesh.

  • The arbitration proceedings shall be conducted in English or Hindi.

  • The arbitral award shall be final and binding on both parties.

Nothing in this clause prevents either party from seeking interim relief from the competent courts including the District Court of Mathura.

19. FORCE MAJEURE

RNI shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to:

  • Natural disasters

  • War or civil unrest

  • Government actions

  • Internet or telecommunications failures

  • Cyberattacks or system outages

20. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain fully valid and enforceable.

21. ENTIRE AGREEMENT

These Terms, along with the Privacy Policy and any additional policies referenced herein, constitute the entire agreement between you and RNI regarding the use of the Service and supersede all prior agreements.
