This petition was submitted by Baijnath Prasad, son of Prashant Saraf, a resident of Bihiya, before the State Election Commission (SEC-Bihar Court) on September 26, 2025. In his petition, Baijnath Prasad accuses Chairman Sachin Kumar Gupta of deliberate negligence in the discharge of his duties. It is alleged that he has not been properly discharging his duties while in office, thereby affecting local public interest and the functioning of the Nagar Panchayat.
This case specifically falls under the provisions of Section 18(1) (g) of the Bihar Municipal Corporation Act, 2007. This section provides important guidelines regarding the disqualification of councilors and chairpersons of municipal corporations. This section clearly states that if a councilor or chairperson is found guilty in a criminal case and remains absconding for a period of six months or more, they may be disqualified from holding the office of councilor.
The allegations against Bihiya Chairman Sachin Kumar Gupta also fall within this serious nature. If the investigation proves that he has indeed not performed his duties and falls within the scope of Section 18(1) (g) of the Bihar Municipal Corporation Act, 2007, his membership could be seriously threatened.
