WHAT HAPPENED IF THE COUNTRY HAS NO SUPREME COURT

RAJIV NAYAN AGRAWAL

ARA---------------------------If there was no Supreme Court in the country then…! Almost all the great legal scholars were included in the assembly formed for the Indian Constitution, who were being looked after by the leadership of Dr. Rajendra Prasad and Dr. Babasaheb Bhimrao Ambedkar. One can imagine that after independence, neither the roads were expanded in the country, nor the railway network was laid, but those great legal experts inspected every corner of the country and woven them into a thread and gave the Constitution in the form of a garland. No matter what anyone says, whether it was made from the Vedas, Upanishads, or by reading the British rules and constitution or any rules and laws of the world, it is an example and even today our head rises with pride by thinking about that book. It is also true that those who did not read and did not think about that book according to time, period and circumstances, they have the right to count the shortcomings in it, but the head automatically bows down to bow down to its makers by imagining them. Now let us try to understand the Indian judiciary a little. No matter how strong, powerful or oppressive someone is in the country, the court, through the powers granted by the Constitution, gives a decision on the basis of evidence of truth or lie and gives him an opportunity to walk on the right path and provides justice to the victim. This is the belief of the society till now and it will remain so in the future too. Some flaws remain sometimes, but that is a human error, which is corrected when it reaches the higher court. Now if we talk about the important decisions of the Supreme Court for public interest and national interest, the country takes them with open arms. This is also because the responsibility of protecting the Constitution has been put on it. For politics, politicians want to serve their own interests in everything, but the Supreme Court is considered the protector of the country's judicial system and Constitution. This is also because the country believes that the decision of the Supreme Court has been taken in public interest and national interest. Meanwhile, one of the important decisions taken by the Supreme Court is that it has warned the government that 'India is not a Dharamshala for refugees from all over the world.' Where in our country even today 80 crore people stand in line to get free government ration, where queues of unemployed people are seen, where lakhs of intruders are still becoming refugees in India, snatching employment from the youth of the country, where farmers keep committing suicide to pay off their loans, how are we giving them shelter in our India? Just think, recently a prosperous nation like America is sending back to India and various other countries by putting shackles on the hands and feet of the NRIs who have entered the country illegally. Why can't such refugees living illegally in India be sent back? This is a very serious problem, on which the government will have to think, otherwise one day the country will be filled with foreign refugees and Indians will be on the road. It is true that India does not do any inhuman act; Because he bows down before humanity. Therefore, the administrators sitting at the top will have to find some way or the other. Therefore, this decision of the Supreme Court should be universally accepted and the government should take steps for this.

Similarly, the case of Islamic Waqf Board remains a topic of discussion, which is with Chief Justice BR Gavai and Augustine George Masih and the country's famous Solicitor General Tushar Mehta is presenting his side on behalf of the government. Last week, the petitioners had demanded an interim stay on the law, saying that this law is going to take over the Waqf properties. This law violates the fundamental right of Muslims to manage their religious property. Now the debate will continue on this. The court especially asked the Rajasthan government about the mysterious suicides being committed by students across the country. And this year, in Kota city, where students go with the hope of their bright future, the Rajasthan government was also put in the dock for the suicides committed by 14 students, asking what did the government think about this? But, there is an important issue on which the court of Chief Justice BR Gavai and AG Masih gave their verdict in the Supreme Court. Today everyone in every part of the country has become familiar with the name of ED (Enforcement Director/Directorate), because its terror has become so much that anyone starts saving his honor out of fear of its name. Its law has been made so strict that if someone gets caught in its clutches, it becomes difficult to get out of it. Although punishing criminals has been going on since the Vedic period, but the kind of fear that ED has created in the country today is worrying. Yudhishthira has told Arjun a lot about the law of punishment. While explaining punishment, he has said that the limit that has been established by the wise people in the world to make people follow their own rules and to protect wealth, is called punishment. If there is no power of punishment in the world, then the entire population will be destroyed. The strong will eat the weak in the same way, like a big fish eats a small fish in water. But, when that punishment is misused, then no one can stop that power from getting destroyed. In the meantime, fed up with ED's similar raids, the Supreme Court has given this decision to bring it on its way. By the way, the court gave this decision while hearing the petitions of Tamil Nadu government and State Marketing Corporation regarding alleged corruption in giving licenses to liquor shops. The state government and the corporation had approached the Supreme Court with a petition. A petition was filed in the court challenging the order of the Madras High Court. Whatever it may be, justice is supreme, the meaning of punishment has been determined to prevent people from going on the wrong path. There has been a provision for punishment in every era. It is there today and will be there in the future too. Therefore, those who violate justice should be careful.
