BHABHUA-----------------------Civil Court Bhabuan court awards 25 years rigorous imprisonment to gangrape accused. On 4th June 2025 at 12:30 PM, the court of ADJ 1st cum Adult Child Special Judge Baljinder Pal Kaimur Bhabuan sentenced the accused Arbaaz Alam alias Pallu, son of Mohammad Zulfiqar Ali, Village- Pipra Karanpura, Police Station- Durgawati, District- Kaimur (Bhabhuan), present address Mohaniya Ward No.- 16, Police Station- Mohaniya, District- Kaimur, for gangraping a minor girl from a village in Mohaniya police station area on 15th November 2019 near Ratwar river on Mohaniya-Bhabhuan road. In which case, a written application was given by the victim cum informant minor girl in Bhabuan Mahila Police Station on 24th November 2019. Whose case was registered in Bhabua Mahila Thana Case No. 82 of 2019. In this case, the court sentenced the accused Arbaaz alias Pallu to 20 years of rigorous imprisonment under Section 376 D IPC. He was sentenced to an additional 1 year of imprisonment for not paying a fine of Rs 1 lakh. He was sentenced to 20 years of rigorous imprisonment under Section 6 of the POCSO Act and two years of rigorous imprisonment for not paying a fine of Rs 1 lakh. He was sentenced to 25 years of rigorous imprisonment under Section 14 (2) of POCSO and 2 years of imprisonment for not paying a fine of Rs 2 lakh. He was sentenced to 10 years of rigorous imprisonment under Section 366 IPC. He was sentenced to an additional 1 year of rigorous imprisonment for not paying a fine of Rs 10,000. He was sentenced to 5 years of rigorous imprisonment under Section 67 B of the IT Act. For not paying the fine of two lakh rupees, he was sentenced to two years of additional rigorous imprisonment. Under Section 506 of the Indian Penal Code, he was sentenced to 4 years of rigorous imprisonment. For not paying the fine of ten thousand rupees, he was sentenced to one year of additional imprisonment. Under Section 504 of the Indian Penal Code, he was sentenced to one year of rigorous imprisonment. For not paying the fine of five thousand rupees, he was sentenced to six months' additional imprisonment. Under Section 342 of the Indian Penal Code, he was sentenced to one year of rigorous imprisonment. For not paying the fine of one thousand rupees, he was sentenced to two months' additional rigorous imprisonment. Under Section 341 of the Indian Penal Code, he was sentenced to one year of rigorous imprisonment. For not paying the fine of five thousand rupees, he was sentenced to six months' additional rigorous imprisonment. Special Public Prosecutor of this case, Ramniwas Ram and the complainant of this case, Advocate Mantu Pandey, Associate Advocate Rishabh Kumar Maurya, presented their side. The complainant's advocate Mantu Pandey said that a minor girl from a village in Mohania police station area had gone to Mohania to buy a copy of her practical exam on 15 November 2019. Around 12 noon, four accused in a Swift Desire car near Mohania Mundeshwari Gate forcibly pushed her into the car and took her to the river on Mohania-Bhabua Road and raped the girl in turns in the closed car. The four people threatened the complainant cum victim that if she files a case and tells anyone in her house, they will get her and her family killed. The victim did not tell anyone about this matter due to fear. On 24 November 2019, three videos of the gang rape incident went viral. The general public blocked the road and vandalized the road in Mohania city regarding this matter. The police had to lathi charge in this matter. A written application was given by the victim cum complainant to the women's Bhabua police station on 24 November 2019. Whose Mahila Thana Bhabuan became case number 82 of 2019. In this case, all the four accused were arrested within two days by the then Superintendent of Police Dil Nawaz Ahmed and the then DM. And on 30 November 2019, a chargesheet was submitted against all the four accused. In this case, the statement of the victim was recorded in the court on 25.11.2019 under 164 of the Code of Criminal Procedure. In this case, TIP was also done in the jail. The trial of one accused is going on in the juvenile court. In this case, the trial of two accused was done by the court of ADJ 6 POCSO Special Judge Ashutosh Kumar Upadhyay Civil Court Bhabuan Kaimur, on 4 March 2023, the accused Sikandar Ansari father Mumtaz Ansari village Mohaniya Ward No. 16, Mohd Shahnawaz alias Sonu father Mohd Akhtar Siddiqui village Mohaniya Ward No. 16 were sentenced to 35-35 years of rigorous imprisonment. In this case, the court has also ordered that the entire fine amount will be given to the victim cum informant. The court also ordered that a copy of the fine be sent to the informant cum victim from the District Legal Services Authority Kaimur Bhabua for providing whatever appropriate assistance is required. This decision is a very historic decision for Kaimur district. The complainant cum victim and her family have got justice in this case. All 11 witnesses have testified in this case.
