PATNA-------------------------Recently, Patna High Court has declared this recruitment policy unconstitutional. The court has clearly stated in its important decision that this policy of the state government provides reservation for a particular community, which is against Article 14 (right to equality) and Article 16 (equality of opportunity in government jobs) of the Constitution.
The court has canceled the policy of the state government of 26 November 2008 and directed it to make a new policy, which is in line with these articles of the Constitution. However, the court has also said that until the selection process under the new policy is completed, the currently appointed people will not be removed from their posts.
Now it remains to be seen how seriously the government of Sushasan Babu takes this order of the Hon'ble Court. This decision will not only bring transparency in the policies of the government, but will also decide whether anyone's will can prevail above the Constitution in Bihar.
