BUXAR------------------------The Special POCSO Court in Buxar has expressed strong displeasure regarding the conduct of the police during the hearing of Brahampur Police Station Case No. 123/2026. Refusing to remand two accused individuals to judicial custody, the court ordered their release on personal bonds of ₹5,000 each.
During the hearing involving Alim Hashmi (23) and Tabis Ali (23)—who appeared before the court of Special Judge Amit Kumar Sharma—several serious procedural irregularities came to light. The court noted allegations that the accused had been detained at the police station since April 26, whereas the police records indicated their date of arrest as April 28.
The court further observed that essential evidence, including the statement of the victim, had not been submitted to the court, thereby raising questions regarding the integrity of the investigation process. Defense counsel Sanjay Kumar Chaubey filed an application in court, stating that on April 25, the accused were assaulted by the alleged victim's family members, following which they had voluntarily gone to the police station. During the hearing, the court also took serious cognizance of the injury marks found on the bodies of the accused, which lent credence to their claims.
Deeming the matter to be of a serious nature, the court has sought an explanation within three days from Brahampur Station House Officer (SHO) Brajesh Kumar and the Investigating Officer (IO) of the case, Vinod Kumar Yadav. Additionally, a copy of the court's order has been forwarded to the Director General of Police (DGP) and the Superintendent of Police (SP), Buxar. The court has scheduled the next hearing for May 14.
