POLICE ACTION IN COACHING DISPUTE COMMENDABLE

17-JUNE-ENG 1

RAJIV NAYAN AGRAWAL

PATNA------------------------The complaint filed by Khan's staff mentions that the guard was assaulted and sustained a head injury; the charges under the BNS (Bharatiya Nyaya Sanhita) are non-bailable, and Roshan Anand has been remanded to judicial custody.

Following an impartial investigation by the Patna Police, it was revealed that the guards had opened fire; both guards have been jailed on charges of attempted murder and violations of the Arms Act.

Patna, June 16 (Tarun Mitra): Politics in Bihar has heated up over two private coaching institutes. Some critics, including opposition parties, are questioning the police's actions. Demands regarding caste, religion, sympathy, and impartial action are being raised on social media platforms. Opposition leader Tejashwi Yadav is demanding a CBI inquiry. JD(U) Working President and MP Sanjay Kumar Jha has also expressed concern, stating that incidents involving bombs, gunfire, and physical assaults at coaching institutes are unacceptable in the current times. Just as the investigation into the coaching institute dispute was underway, the body of the accused, Prince, was found in a hotel in Nepal. The Nepal Police is taking action, and the Bihar Police is maintaining constant contact. It is natural for everyone to sympathize with Prince's death. In criminal cases, the police view everyone involved with suspicion, yet all accused are presumed innocent until convicted by a court. The Supreme Court has clearly ruled that there can be no interference until the police or investigative agency files a charge sheet. Under these circumstances, questioning the police's actions or their modus operandi is entirely inappropriate. Senior Advocate Ramakant Sharma of the Patna High Court, representing Roshan Anand, also stated to the media that the police's action is proceeding in the right direction; had the police not acted correctly, these facts would not have come to light.

Khan Global and Gyan Bindu coaching institutes are located within the cold storage campus in the Kadamkuan police station area. Both institutes provide preparation for various examinations, including competitive exams. Thousands of students study at these two educational institutions. In this modern and developed era, education is no longer an act of charity as it once was; instead, it has transformed into a business or commercial enterprise. Promotional campaigns often rely on falsehoods to attract the highest possible number of students. No government agency verifies the actual success rates claimed in examinations; it is essentially a case of "blowing one's own trumpet." In such an environment, professional jealousy is inevitable.

Rivalry between the Khan Global and Gyan Bindu coaching institutes had reached a fever pitch. Jealousy was the primary cause behind the incident of assault and gunfire that occurred at 10:30 AM on June 2nd. For quite some time prior to the incident, both educational institutes had been campaigning against each other and trading a barrage of false accusations. Students had also begun to get drawn into this conflict between the two institutions. CCTV footage clearly shows stones being thrown at Khan Global, acts of vandalism, and physical altercations involving both sides; a security guard at Khan Global suffered a head injury during the scuffle. Upon receiving information that hundreds of students from both institutes were clashing, senior Patna police officers—along with personnel from the local police station—rushed to the scene. Director General of Police (DGP) Vinay Kumar explicitly ordered the Patna police to pacify the students and disperse them from the area as quickly as possible, insisting that students must not be involved in this dispute under any circumstances. Anticipating that the situation could escalate, DGP Vinay Kumar sought constant updates from Patna IG Jitendra Rana and SSP Kartik Kumar Sharma; he managed to bring the entire situation under control before rumors could spread.

Regarding the FIR registered in connection with the clash between Khan Global and Gyan Bindu coaching, a case (Case No. 410/26, dated June 2, 2026) was filed at the Kadamkuan Police Station based on a written complaint submitted by Khan Global staff member Kanhaiya Kumar Singh. The FIR clearly states that at the behest of Roshan Anand—the proprietor of Gyan Bindu Coaching—a group of 15–20 youths, accompanied by Abhishek, Prince, and staff members Roshan and Gaurav, arrived at the coaching center's gate. They dragged the guard out, assaulted him (causing a head injury), hurled verbal abuse, and vandalized the premises. Based on the written complaint filed for the FIR, the Station House Officer (SHO) invoked several sections of the law, including the non-bailable Section 109 of the BNS. Subsequently, students from both institutions began spreading rumors on social media. Faisal Khan (alias 'Khan Sir'), the owner of Khan Global, caused a sensation by claiming that a shooting had taken place, even though his staff had made no mention of any gunfire in the written complaint submitted for the FIR. Regarding the assault on the Khan Global guard that resulted in a head injury, the police arrested Roshan Anand and produced him before a Judicial Magistrate. After considering the allegations and evidence, the Judicial Magistrate remanded the accused, Roshan Anand, to judicial custody. Had the allegations and evidence not been serious, no Judicial Magistrate would have ordered imprisonment. Under these circumstances, questioning the police's actions does not appear logical.

Reports of a physical altercation between Khan Global and Gyan Bindu Coaching had surfaced. Initially, Faisal Khan (alias 'Khan Sir') spoke to the media about a shooting incident; however, the failure to mention any gunfire in the FIR cast doubt on his claims. Yet, why did Roshan Anand—the owner of Gyan Bindu Coaching—along with his brother Prince and other staff members, not file an FIR against Khan Global's owner Faisal Khan, his guard, and others? Why did Roshan Anand, his brother Prince, and other staff members conceal the details regarding the assault and the firing? It cannot be claimed that they lacked the opportunity to do so; even when the police arrested Roshan Anand, an FIR could have been lodged against Faisal Khan, his guards, and the others involved. Such an action would have clarified who initiated the altercation.

Conducting an impartial investigation, the Patna Police sent the guard involved in the shooting to jail and registered an FIR against Khan.

Faisal Khan—also known as 'Khan Sir'—had spoken about the firing incident but completely backtracked when the FIR was filed, casting suspicion on the situation. Initially, the Patna Police had also denied reports of any firing. Meanwhile, despite being fully aware of the facts, Raunak Anand (owner of Gyan Bindu Coaching Institute), his brother Prince, staff members Roshan and Gaurav, and others concealed the details of the shooting; they did not even file a counter-FIR. Subsequently, the police investigation began. As the police questioned locals and examined CCTV footage, the truth came to light. The police obtained a video showing Faisal Khan's guards opening fire. Upon being detained and interrogated, the guards—Pradeep Kumar and Talebar Singh—revealed that Chunchun, a security guard stationed at the gate of Khan Global Coaching, had been assaulted and injured. Following this, Khan Sir emerged from his office and ordered the crowd to be fired upon, instructing them to shoot and assuring them he would handle the consequences; the two guards then fired two rounds each from their rifles. The Patna Police arrested both guards and sent them to jail, while also registering a case at the Kadamkuan police station (Case No. 418/26, dated 04/06/26), naming Faisal Khan (Khan Sir) as an accused. The Sessions Court has stayed Khan Sir's arrest and summoned the case diary. Had the police not acted impartially, the shooting incident would not have been exposed, no FIR would have been lodged, and the two guards would not have been jailed. If Khan Sir's background is being scrutinized today, it is part of impartial police action; any further action taken by the police will also be impartial and within the bounds of the law.
