PATNA---------------------------The Bihar government has expanded the scope of powers vested in District Magistrates (DMs) to tighten the grip on anti-social elements and organized crime. Following recent amendments to the Bihar Control of Crime Act (Bihar CCA), DMs have been authorized to take action under the CCA against criminals involved in seven categories of serious offenses. The government's move aims to establish effective control over activities such as organized crime, land mafia operations, illegal mining, human trafficking, and the spreading of hatred via social media. Under the amended provisions, individuals causing large-scale, illegal damage to public or private property have also been brought within the ambit of the CCA. Furthermore, action can now be taken under this law against land mafias who illegally dispossess individuals of their movable or immovable property. This grants the administration additional authority to act in cases of forcible occupation of land and property. Land disputes and illegal land encroachment have long posed a significant challenge for the administration in Bihar. Allegations frequently surface regarding organized gangs or powerful individuals seizing the land and property of vulnerable persons. Following the amendment, DMs will be empowered to initiate action under the CCA in such cases, provided the stipulated legal criteria are met. The government has also included organized misconduct within the scope of this act. This paves the way for strict action against individuals involved in activities that systematically disrupt law and order. The administration will be empowered to take measures under the provisions of the law based on the activities of the concerned individual or gang and the available evidence. The government has also prepared to crack down on criminals involved in illegal mining. Curbing the illegal mining and transportation of sand and other minerals across various regions of Bihar remains a persistent challenge for the administration. Complaints regarding the involvement of organized networks behind illegal mining often surface. Under the amended CCA, District Magistrates will gain greater authority to take action against such organized criminals. Recognizing the growing influence of social media, the government has also addressed its misuse within the amendment. Offenders involved in activities that incite hatred or disrupt social harmony via social media will now also fall within the ambit of the CCA. The objective is to control online activities that pose a threat to public order and social peace. However, when taking action in cases related to social media, established legal standards and available evidence will play a crucial role. It will be significant. Action based on a post or content will only be possible if it falls within the ambit of the amended law's provisions. The administration will be required to examine digital evidence and relevant circumstances in such cases. Provisions have also been made to take action under the CCA against offenders involved in human trafficking. Cases of human trafficking often reveal the involvement of organized networks spanning multiple districts or states. The administration will now gain additional legal authority to act against such networks that target women, children, and other vulnerable sections of society. The government is focusing on crimes that do not merely affect an individual but impact public order, social security, or the interests of a large number of people. With this in mind, District Magistrates have been authorized to invoke the CCA against elements involved in seven categories of serious offenses. The amendments to the CCA will also increase the responsibilities of District Magistrates; before taking action against an individual, they must study the specific case, the nature of the crime, its impact, and the available evidence. Every action taken under the law must adhere to prescribed procedures and legal provisions. The impact of the amendment is likely to be particularly visible in cases involving land mafias and illegal encroachments. By cracking down under the CCA on organized elements actively involved in the illegal dispossession of individuals from their movable and immovable property, the administration will have an additional tool to handle such matters. Similarly, action against organized gangs involved in illegal mining is also expected to intensify. The government has already been conducting campaigns against illegal mining and transportation; the new provisions will further enhance the role of the district administration in tackling such organized networks. By bringing activities like human trafficking and the dissemination of hate speech on social media within the legal ambit, the government has clearly signaled that it will keep a close watch on emerging forms of crime. If digital platforms are used to disrupt public order or spread hatred, the administration will be empowered to take action in accordance with legal provisions. Following this amendment to the Bihar CCA, attention will now shift to its implementation across the districts. The government expects to effectively curb organized crime and anti-social activities through the additional powers granted to District Magistrates. In the near future, strict action under this law is likely to be witnessed against the land mafia, illegal mining, human trafficking, and organized crimes that disrupt public order.
